Mumbai Municipal Corporation abetting animal sacrifice







According to PCA 1960 an animal can only be killed as provided under section 11(3)

(c) the extermination or destruction of any animal under the authority of any law for the time being in force; or 

(d) any matter dealt with in Chapter IV; or 

(e) the commission or omission of any act in the course of the destruction or the preparation for destruction of any animal as food for mankind unless such destruction or preparation was accompanied by the infliction of unnecessary pain or suffering

Chapter IV deals with Experimentation of animals.
The exemption related to religion is dealt with under section 28 and refers to the manner in which an animal is killed and not purpose.

28. Saving as respects manner of killing prescribed by religion : Nothing contained in this Act shall render it an offence to kill any animal in a manner required by the religion of any community.


It is therefore clear that the Corporation is abetting an immoral and allegedly illegal act by making goats available for animal sacrifice.


Also keeping of animals is illegal within Mumbai city limits except as provided under various sections of Mumbai Municipal Corporation Act 1888, particularly sections 316, 384, 384(A), 394, 394(A), 398 to 412 etc.

The Commissioner has given his order under Section 403 2(e) of MMC Act, 1888. However FSSAI Act and PCA Acts are central acts whose provisions override these local Acts.

Terms and conditions under which such permission will be given are as follows:-

TERMS AND CONDITIONS FOR PERMISSION OF RELIGIOUS SACRIFICE SLAUGHTER OF SHEEP/GOAT UNDER 403 (2) (e) of MMC ACT 1888
  • Only one goat's permission will be received on an application.
  • Applicant must be residing within the jurisdiction of Mumbai Municipal corporation.
  • Applicant shall sacrifice sheep/goat solely for religious or ceremonial feast and not for commercial purpose.
  • Sheep/goat sacrifice shall be carried out in such a confined place which will not be observed by any person or neighbouring premises or any member of public.
  • Shall collect waste material generated after sacrificial slaughter and deliver it to special vehicles arranged by Solid Waste Management department for this purpose
  • Care should be taken to ensure welfare of sheep/goat from transportation to slaughter
  • Sacrificial place shall be provided with receptacle to collect slaughter waste immediately after sacrifice
  • No sheep/goat shall be administered by any chemical or drug or hormone before slaughter.
  • Hides or skin shall be transported immediately from slaughter place in a closed manner.
  • Area shall be cleaned immediately with sanitizing agent after sacrifice.
  • Applicant who seeks permission for religious sacrifice of sheep/goat shall seek NOC of concerned housing society wherever necessary.
  • Applicant shall use the permission as provided in the application in accordance with the terms and conditions accepted by the applicant and shall bear the sole responsibility of it.
